My wife has illegal relations which I did not know at the time of marriage. She is a characterless lady so I want divorce. I got married in 2008, and my marriage life is still very good till Dec 2019. In Dec 2019 I found that my wife has been characterless for so many years, approx 5 to 7 years. But I have no solid proof. After Dec 2019 to till date I found she has an abnormal negative change in her behaviour with me and my 70 years old mother. She misbehaving with me and my mom. And she gives us warnings every day about police cases. 

And finally she claims 498-A in mahila police and 125 in court. My question is that I’m ready to accept her.but she does not want to come. She claim a totally wrong case against me. I am in trouble. She is misusing ladies law. What can I do? I also have a 12 years old child with her. I think she has no feelings for me.

Can I get maintenance from my unemployed husband? My husband is unemployed due to heavy losses in business during the Covid period. He is still not working but capable of feeding his family. Recently he has developed an illegal relationship with his ex-employee and is planning to marry her. 

Therefore, there was a lot of quarrel between us after the revelation of that relationship. Now I have left his house and am currently living with my parents. I want to claim maintenance from him.

My stepmother is receiving the family pension and has all retiral benefits such as provident fund, gratuity etc. She is living a good life but claiming more money from me. I am a software engineer and currently in the USA. We are a very reputed family in our society. My mother died in 1984. thereafter my father contracted a second marriage. My stepmother is very greedy and plans to claim maintenance from me. I came to know this fact through my friends and family members. I want to know whether stepmother can claim maintenance when she is living a good life? 

My wife filed a maintenance case under section 125 CrPC. The court has passed a maintenance order without hearing the husband. I did not appear in court due to illness and fear of covid infection. My wife’s advocate appears in the court and says that the husband does not honour the court. The court, without giving me one more opportunity to appear, has passed the maintenance order. Sir, what remedy do I still have to save me from such a bad judgment?

I am fifteen years old and living with my married sister. A minor daughter can claim maintenance against her father if he does not provide fooding, lodging and education fee etc. My father contracted second marriage after my mother’s death. He has a son out of that wife. My stepmother is very abusive and using bad words against me. Due to bad behaviour of my parents I have been living with my sister. She is married and living in Chandigarh. My father does not paying my school fee and other genuine expenses. I am in very trouble please help.

I have received a notice under section 128 crpc. My wife filed a maintenance case under section 125 of the code of criminal procedure. The court has passed final order in that case to pay rupees seven thousand per month as a maintenance. This is too high maintenance and beyond my financial capacity. Therefore, I filed a revision before the sessions court but due to COVID I could not appear. Consequently it has be dismissed. Now my wife is approaching the court to implement it order. Yesterday I have received a notice.

मेरी पत्नी ने मेरे तथा मेरी मां के विरुद्ध घरेलू हिंसा का केस दर्ज किया था जो कि न्यायालय द्वारा 5 फरवरी 2020 को खारिज कर दिया गया है. इसके पश्चात मेरी पत्नी ने अपने मायके जाकर धारा 125 के अंतर्गत भरण पोषण का दावा किया है. मेरी पत्नी शैक्षणिक रूप से सक्षम है तो क्या मुझे 125 के अंतर्गत भरण पोषण देना होगा? 

Judicial Magistrate has awarded excessive maintenance under section 125 crpc. An Order on section 125 crpc is passed by Kalyani judicial magistrate court ordering a final maintenance amount of Rs.7000. The wife has left me on her own will and I have sent 3 letters asking her to come back. I have also mentioned that my earning is Rs.16000/- per month from my homoeopathic shop.

But the court has not considered the facts and awarded such a hefty amount. Can I challenge the order in Calcutta High court or should I go to district judicial magistrate court? Which is a better option? I have also filed a divorce case on Dec 2018 and my wife has not appeared so the court has passed ex-parte order. Now the final divorce order will soon be passed. Please help how could I reduce my maintenance amount?

My husband is living in Delhi, and I am in Kanpur. He has expelled me from the marital home and also does not want to give maintenance. Therefore, I want to file a complaint under section 125 CrPC for maintenance. Is it necessary to file the affidavit of husband and wife for filing of the complaint under section 125?
