Husband purposely became jobless to frustrate my case. I filed a lawsuit in court under the protection of women from domestic violence act 2005 under sec 12,18,19,20 & 23. How I will get interim maintenance from my husband if he is purposely jobless?. I am having a daughter of 1yr to take care off.

My husband is working in Aditya college for 15000 per month. We have a baby 12 months old. We didn’t even own house to live. His stepmother is asking for maintenance 3000 every month. Sir, I have applied to section 125 CrPC for maintenance. During the pendency of that application, my husband unanimously gave divorce. He is planning to marry another woman. After that, I filed another petition under section 3 of the Muslim Woman (Protection of Right on Divorce) Act 1986, for delivery of my ornaments and other belongings.

However, he delivered all the items and paid maintenance during the Iddat period, but he is neglecting to maintain beyond the Iddat period. In the meantime, he filed a reply in the proceeding under section 125 that Muslim woman is not entitled to the maintenance after the Iddat period and he does not want to proceed under section 125 whether I’m still entitled to the maintenance after Iddat period.

Sir, I refused to live with my husband due to deliberate demand of dowry and act of cruelty. I filed a maintenance case against him under section 125 of CrPC then court granted maintenance. My husband approached my family to reconcile the dispute and convince me to live with him. He approached my family with an ulterior motive to frustrate the maintenance order.

Respected sir, my husband was taken lots of unreasonable adjournments to delay the judgment in my maintenance petition. I have filed a petition in the year 2000 and got judgment in September 2015.

The court in the judge gave the order of maintenance from the date of order instead of from the date of filing of the petition. No interim maintenance had been received and no other relief was sought by me. I want to appeal this judgment for giving maintenance from the date filing of my petition.
