Property Cases

Daughter has the right in ancestral property

My mother was eligible for her father’s ancestral property accordingly to THE HINDU SUCCESSION (ANDHRA PRADESH AMENDMENT) ACT 1985. She got married after the amended Act. She didn’t fight for her rights when her brothers sold the property after my grandfather’s death in 1994. She did not sign on the sale deed. Can she go to court for her right today? Will the limitations act affect her rights? Is the sale deed valid?

Can a person claim ownership on the basis of mutation

Father purchased a plot out of his own income but the plot was registered in the name of my mother. The said plot is muted in my mother’s name, therefore, my mother claims that she is the absolute owner of the plot. I have one brother and one sister all are married I have a very strange relationship with my mother.

Because of the strange relationship my mother does not like me. Last year my mother made a Will and transfer the said plot to my sister. At this point of time can I move any legal proceeding for cancellation of such transfer?

Step mother sold joint family property

My father has made a gift in favour of his second wife who is my stepmother thereupon she took possession over the property. She sold that property to his son-in-law thereafter my step sister erected a house thereon.

The property gifted was probably our joint family property. However, there is no evidence to prove that my father made a gift but I am quite sure that she forced my father to transfer the property upon her. My stepmother illegally dispossessed me from the land then sold it to her son-in-law. Can I challenge this gift?

Leave and licence

A person intentionally treated the lease document as leave and license. He is trying to evict the person in whose favour that lease deed is executed. What are the ingredients of lease and leave & license?

Unregistered lease

I gave my house and adjacent land for manufacturing of shoes. That house was given on lease. The lease deed was unregistered, but both parties signed it. The lease was accepted on payment of twenty thousand rupees per month as rent.

The lessee enjoyed it for four years. That lease was for 8 years. Now I want to file a case for recovery of rent for 2 years and also for the compensation of remaining years. The lessee vacated the house without giving notice. Please guide about unregistered lease deed and opportunity to get compensation.

Sale of property by POA holder

I purchased Plot in 2010 with power of attorney. The power of attorney was given to some person by the original owner. I started construction in 2016 on the plot. Now the thing is coming that the original owner is denying that he has not given power of attorney to any person and the signature done on POA is not his signature. He has decided to launch FIR in the police.

Please let me know what will be the effect on me if POA is really fake. All original documents with channels are with me. As I am the bona fide purchaser now legally, what consequences can occur? And what should I do as my advocate is telling not to fear all documents are up to date.***Please give your advice.

Transfer of trust property

My grandfather has created a trust for the construction and running of a school. He had appointed my father as trustee. My grandfather died in the year 1974. My father dies in the year 2015. This trust is created by a Will, according to it I am the trustee of this trust but I came to know that my father has transferred this right and appointed Mr X as trustee. It is a private trust and father has no right to appoint another person as trustee. I have filed a civil suit, which is the possibility to win.
