Order of dismissal without giving any reason

I have been dismissed on the oral complaint but nowhere that complaint is mentioned in the dismissal order. That order of dismissal was passed without giving any reason. The departmental inquiry is initiated without recording formal complaint and information about my misconduct. I have opposed that proceeding but dismissed from service without any reason. I want to take appropriate legal action against the government. Please suggest appropriate legal action which I can take in this matter. 

Stay of departmental inquiry during criminal prosecution 

Can I seek a stay of departmental inquiry during criminal prosecution? The government has filed a criminal case against me on the complaint of a MLA. That MLA has asked a question in the assembly and made several allegations against me. The government took the cognisance of those allegations and initiated a departmental inquiry. Later on a criminal case has filed against me. Both cases have the same allegations. I want a stay of departmental inquiry during the pendency of criminal case. Please help!

Reduction of age criteria in bank examination

Sir, recently the State Bank of India released notification for clerical posts. Till now for the age criteria the reference month is April, but this time without prior notice they’ve changed it to August. This will make many candidates who are born prior to August ineligible to apply. Is there any legal ground to file a case regarding this issue? Can I challenge the reduction of age criteria in bank examination?

Punishment passed without considering representation against the show cause notice

In my case punishment passed without considering my representation against the show cause notice. I have received a show cause notice for not submitting daily reports to the head office. Therefore, the Divisional Area Manager has issued a show cause notice that why you should not be punished with the censure entry? When I submitted my representation, he overlooked and passed an arbitrary order of punishment. Can I initiate legal proceedings for the quashing of such an order? 

Disciplinary authority is bound to furnish the report of inquiry officer before inflicting punishment

The department has initiated a departmental inquiry against me for committing false entries in the log book. No charge sheet, evidence, report of inquiry officer and materials had served to me before inflicting punishment. I want to know whether the disciplinary authority is bound to furnish the report of the inquiry officer before inflicting punishment?

My superior officer had seized the log book and all relevant files before sending a complaint against me. I have been on suspension since october 2013 without a subsistence allowance. My family is living in vegarancy. Recently the department has lodged a first information report against me. How could I save me and my family?

Senior officer has converted my character roll entry from outstanding to satisfactory

One of my senior officers is not happy with my action against the defaulter contractor. My project manager has assessed my character roll and entered as outstanding because I have completed the project work before time. I have tightened the control over the defaulter contractor and cancelled their contract and recovered a huge amount from them. The effect of my action bound the other contractor to accomplish the work before time.  The managing director has converted my character roll entry from outstanding to satisfactory without my knowledge. Therefore, it’ll affect my timely promotion. Sir please suggest what I should do in this case? 

Withholding of salary without any reason

I’ve been on an unpaid service for last 3 months, progressing into 4th, purely on frivolous grounds, at the whims of accounting unit head,  without following due process of law, as laid down in Central Civil Services (Conduct) rules, without any charge-sheet, denying any representation subsistence too. What recourse do I have in this matter?

Government has rejected my claim of compassionate appointment due to delay

My husband died during the service. At the time of his death in 2010, I was in shock therefore, could not apply for the compassionate appointment. One more thing is that my son was a minor and he was studying in class six. Now he became the major and completed his graduation. Hence, I applied for the compassionate appointment for my son in January 2022. But the government has rejected my claim of compassionate appointment due to delay. In this situation can my son get a compassionate appointment? Please guide me.

Can the department terminate my service due to non-disclosure of a compromised case at the time of joining?

I was working as a technical officer in the BHEL. At the time of appointment I did not disclose the criminal case which was compounded after the compromise between the parties. Can the department terminate my service due to non-disclosure of a compromised case at the time of joining? That FIR was lodged under Section 323, 504, 506 IPC. Actually there was a dispute in respect of agricultural land. 

We are the owners of five bigha land where a national highway is going through. The owner of adjoining land was demanding a passage from our land. He wanted to open a restaurant but due to narry access his plan was not materialising. Then he lodged an FIR against us. In that FIR the investigating officer never arrested us and also did not file a charge sheet.

We also filed a cross case against them. Then we approach the court and submit a compromise deed. Thereafter the court had compounded the case. At the time of joining I thought that I should avoid mentioning that false and frivolous case in the form. 

Therefore, I did not mention the information of that criminal case in the joining form. Now the BHEL has terminated my service upon receiving a complaint that I have concealed material fact. BHEL did not issue a notice and did not provide me an opportunity of hearing. What should I do?
